Passenger Transportation Agreement

1. Parties

This agreement is made between:

Carrier: Volva İnşaat Gıda Turizm Ltd. Şti - Ergenekon, Halaskargazi Cd. No:8/8 Şişli/İstanbul
Passenger: The individual who makes a reservation through the viptoursistanbul.com, by phone or email

2. Subject Matter

The subject matter of this agreement is the provision of passenger transportation services by the Carrier to the Passenger, under the terms and conditions set forth below.

3. Scope Of Service

3.1. The Carrier undertakes to transport the Passenger from the pick-up point (e.g., airport, hotel, address) specified by the Passenger in the reservation made through the website, by phone or email, to the destination point (e.g., airport, hotel, address).

3.2. The transportation service will be provided with vehicles owned by the Carrier or leased by the Carrier, suitable for passenger transportation.

3.3. The Passenger is responsible for carrying their baggage and personal belongings. The Carrier will be responsible for the safety of the baggage and personal belongings during the journey, along with the passenger. Oversized or heavy baggage may not be transported if it exceeds the carrying capacity. The passenger will be informed prior to the service.

3.4. The transportation service will be provided within the time and date range specified in the reservations made through the website, by phone or email. The Carrier acknowledges that delays may occur due to traffic, weather conditions or other unforeseen circumstances. In such cases, the Carrier will inform the Passenger as soon as possible and will attempt to offer a reasonable solution.

4. Fees And Payment

4.1. The Passenger agrees to pay the fee specified on the website, or communicated to them during the reservation made through the website, by phone or email, in exchange for the transportation service.

4.2. Payment may be made during the reservation or following the completion of the service, via credit card, debit card through the website or cash. For reservations made by phone or email, the payment method may be agreed upon with the Passenger during the reservation.

4.3. Prices include VAT. However, additional expenses such as highway tolls, bridge fees, and parking fees, unless otherwise specified, are the responsibility of the Passenger.

5. Reservation Cancellation And Changes

5.1. The Passenger may cancel their reservation free of charge 1 hour prior to the service date. Cancellation requests can be made through the website, by phone or via [email protected].

5.2. In case of cancellations within 1 or if the Passenger withdraws from the service, 50% of the fee will be refunded to the Passenger.

5.3. The Passenger can change the reservation date and time 1 hour before the service date, subject to the availability of the Carrier. Change requests can be made through the website, by phone or via [email protected].

5.4. The Carrier reserves the right to cancel or postpone the service due to force majeure (natural disasters, state of emergency, vehicle breakdown, etc.). In this case, the full amount of the fee paid to the Passenger will be refunded.

5.5. Waiting Time: The Carrier will wait for the Passenger free of charge for up to 90 minutes from the arrival time at the destination point specified in the reservation. If the Passenger is not ready within this time, the Carrier reserves the right to charge an additional fee for the waiting time.

6. Passenger's Obligations

6.1. The Passenger is obliged to comply with the laws and regulations in force during the transportation service.

6.2. The Passenger must not smoke inside the vehicle.

6.3. The Passenger is responsible for any damage that may occur during the transportation service (e.g., damage to the vehicle, contamination) and is obliged to compensate for these damages.

6.4. The Passenger is obliged to provide accurate and up-to-date information in the reservations they make through the website, by phone or email.

7. Carrier's Obligations

7.1. The Carrier is obliged to use safe and well-maintained vehicles suitable for passenger transportation.

7.2. The Carrier is obliged to take the necessary precautions to ensure the safety of the passengers.

7.3. The Carrier is obliged to treat passengers respectfully and courteously.

7.4. The Carrier is obliged to keep the passenger's personal information confidential and to comply with the privacy policy.

8. Limitation Of Liability

8.1. The Carrier will be liable for material or moral damages that the Passenger may suffer during or after the transportation service, only for damages arising from its own fault.

8.2. The Carrier cannot be held responsible for damages arising from traffic accidents, delays or force majeure.

8.3. The Carrier's liability is limited to the transportation service fee.

9. Dispute Resolution

The Istanbul Courts and Enforcement Offices will be authorized for the resolution of disputes arising from this agreement.

10. Other Provisions

10.1. This agreement may be amended in writing with the mutual consent of the parties.

10.2. The invalidity of any provision of this agreement shall not affect the validity of the other provisions.

10.3. This agreement enters into force when it is published on the website or when a reservation is made by phone or email.
